Copyright (DMCA) notice

Designated agent

WhatTrust is operated by Twilight Media Design Corporation (operator of WhatTrust, whattrust.com). Notices of claimed copyright infringement and counter-notices must be sent to our designated agent, registered with the U.S. Copyright Office (registration DMCA-1084735):

AgentCopyright Compliance Department, Twilight Media Design Corporation
Emailinfo@tmd360tech.com
RegistrationDMCA-1084735 — U.S. Copyright Office DMCA Designated Agent Directory

The agent's full postal address and telephone number are listed in the Copyright Office directory under registration DMCA-1084735.

You may also use the report form (category “copyright”), provided your report contains every element below and an email address for reply.

What a notice must contain

Under 17 U.S.C. §512(c)(3), a notice must be in writing and include substantially:

  1. a physical or electronic signature of the copyright owner or a person authorised to act for them;
  2. identification of the copyrighted work claimed to be infringed (or a representative list if several works are covered by one notice);
  3. identification of the material claimed to be infringing and information reasonably sufficient to locate it (the exact URL on the WhatTrust-hosted website);
  4. your name, address, telephone number and, if available, email address;
  5. a statement that you have a good-faith belief that the use is not authorised by the copyright owner, its agent or the law; and
  6. a statement that the information in the notice is accurate and, under penalty of perjury, that you are authorised to act on behalf of the owner.

On a valid notice we act expeditiously to remove or disable access to the material — usually by taking the hosted website offline — and promptly notify the website's owner with a copy of the notice.

Counter-notice

If your material was removed by mistake or misidentification, you may send a counter-notice to the designated agent containing (17 U.S.C. §512(g)(3)):

  1. your physical or electronic signature;
  2. identification of the material removed and the location where it appeared before removal;
  3. a statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification; and
  4. your name, address and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if your address is outside the United States, any judicial district in which WhatTrust may be found), and that you will accept service of process from the person who provided the original notice or their agent.

We will promptly send a copy of a valid counter-notice to the person who sent the original notice and restore the material not less than 10 and not more than 14 business days after receiving it, unless our designated agent first receives notice that the complaining party has filed an action seeking a court order to restrain the alleged infringement.

Repeat infringers

WhatTrust terminates, in appropriate circumstances, the accounts of subscribers who are repeat infringers. We record each removal made after a valid notice that is not successfully countered or withdrawn; an account with three such removals within twelve months has its website publishing suspended and is reviewed for termination. We may act sooner where infringement is blatant or wilful.

Misrepresentation

Under 17 U.S.C. §512(f), anyone who knowingly materially misrepresents that material is infringing, or that it was removed by mistake, may be liable for damages. If you are unsure whether material infringes, consider seeking legal advice first.

Other complaints (phishing, fraud, trademark, privacy and unlawful content) use the report form; they are not handled under the DMCA.
